Opinion of the European Economic and Social Committee on the UN Convention on the Protection of the Rights of all Migrant Workers and Members of Their Families, 2004

In line with the opinions it has drawn up on European immigration policy and in support of the opinion of the European Parliament (Resolution A5-0445.2003), the European Economic and Social Committee encourages the Member States of the European Union to ratify the International MW Convention, which entered into force on 1 July 2003.

The EESC calls upon the President of the Commission and the current Presidency of the Council to undertake the necessary political initiatives to ensure that the Member States ratify the MW Convention within the coming 24 months. To facilitate ratification, the Committee propose that the Commission should carry out a study analysing national and Community legislation relating to the convention.

EESC also features the speeches (by EESC president, ICFTU, Council of EU, IOM, UNESCO, ILO, AI, ENAR, CCME, December 18) given during the EESC hearing on the Convention that took place on May 4, 2004.

Flemish government, Belgium, 2004

Following the IMD Platform campaign, the Flemish government decided on April 30, 2004 to officially support a Belgian ratification of the UN MW Convention.


European Parliament, 2002-2004

Parliamentary written question regarding the EC position vis-à-vis the UN MWC and European campaign.

In the framework of the Belgian campaign for the ratification of the UN MWC and following action undertaken by Wereldsolidariteit, Ms. Miet Smet, Member of the European Parliament, asked on January 9, 2004, the European Commission this parliamentary question.

While the European Commission supported in 1994 the Convention and called upon the Member States (see further under 1994 for text) to ratify, Mr. Vittorino replied on 5 March 2004 that the question should not be addressed to the EC but to the governments. For the complete text, click here.

On 17 February 1998, the European Parliament adopted for the first time a resolution on the situation of the human rights in the EU. One part concerning immigration and the right to asylum mentions that the Parliament regrets the fact that the Convention is not ratified yet by a Member State. Parliament of Catalonia, Spain, 2003

On April 22, 2003, as a follow up of a request by the local NGO Coalition for the International Migrant's Day, the Parliament of Catalonia adopted the following resolution:

The Parliament of Catalonia urges its Government to make the necessary steps and appropriate arrangements with the Spanish Government for it to solemnly sign and ratify the International Convention on the Protection of the Rights of All Migrant Workers and Members of their Families, in order to complete the legal regulatory framework on foreigners' stay in Catalonia.

European Commission, 1994

The Commission of the European Union issued in 1994 a Communication which, among other matters, called upon the Member States to ratify the Migrant Workers Convention: Commission of the European Communities, "Communication from the Commission to the Council and the European Parliament on immigration and asylum policies" (Brussels, Com (94) 23 final). Text is as follows:
132. The International Convention on the protection of the rights of all migrant workers and members of their families, adopted by the UN General Assembly on 18 December 1990, must be ratified by 20 countries to enter into force. The ratification of this convention by the member states would be an expression of the value the Union attaches to the improvement of the situation of migrant workers and their families residing in the Union and guarantees that the rights accorded to them correspond with the most high level international norms.

December 18 is an NGO in Special Consultative Status with the Economic and Social Council of the United Nations.

Financial support for operational costs is provided by Oxfam-Novib (Netherlands). Other funders may occasionally support special activities.
